General Terms and Conditions (GTC)

  1. Scope
    These GTC apply to all purchase contracts concluded via the online shop of In Vino Weix Weixelbaum GmbH (hereinafter the “Seller”) between the winery and the customer. By placing an order, the customer agrees to these GTC.
  2. Conclusion of contract
    The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. By clicking the “Buy now” button, the customer places a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order is sent immediately after submission by an automated email.
  3. Protection of minors
    Wine and spirits are sold only to persons over 18 years of age (or in accordance with the applicable statutory age limits of the country of delivery).
    By placing an order, the customer confirms that they have reached the legally required minimum age.
  4. Prices and shipping costs
    All prices are in euros and include the statutory Austrian VAT.
    In addition to the stated prices, we charge shipping costs depending on the order value. These are clearly indicated in the shopping cart system and on the order page.
    For deliveries to countries with customs duties or alcohol tax, fees may apply, which must be borne by the customer.
  5. Delivery conditions
    Delivery is made by DPD to the address provided by the customer.
    Within Austria, the delivery time is generally 3–5 business days, unless otherwise stated. Events of force majeure are excluded.
  6. Payment terms
    The customer may use the payment methods offered in the online shop; we process payments via the Stripe online payment platform.

    The goods remain the property of In Vino Weix Weixelbaum GmbH until full payment has been received.
  7. Right of withdrawal (right of cancellation)
    Consumers have the right to withdraw from this contract within 14 days without giving any reason. The period begins on the day on which the customer, or a third party designated by the customer who is not the carrier, takes possession of the goods.

    To exercise the right of withdrawal, the customer must inform us by means of a clear statement, by letter or email.

    If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

    We may refuse reimbursement until we have received the goods back, or until you have provided evidence that you have returned the goods, whichever is earlier.

    You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract, to “In Vino Weix Weixelbaum GmbH, Weinbergweg 196, A-3491 Strass im Strassertal”. The deadline is met if you send the goods before the expiry of the fourteen-day period.

    You shall bear the direct costs of returning the goods.

  8. Warranty and liability
    The statutory warranty provisions apply. “Cork taint” is a recognised natural defect. Impairments caused by defective cork are not the responsibility of the winemaker. Faulty bottles will be replaced under the following conditions: the faulty bottle is re-corked with the defective cork and returned to Weixelbaum Winery in Strass.
  9. Data protection
    The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations. When you use this website, various personal data are collected. Personal data are data by which you can be personally identified. Please note that data transmission over the internet (e.g. when communicating by email) may have security vulnerabilities. Complete protection of data against access by third parties is not possible.

    If you contact us by email, the data you provide will be stored by us for six months for the purpose of processing your request and in case of follow-up questions. We will not pass this data on without your consent.

    In addition, for the purpose of processing the contract, the following data are also stored by us: purchased goods and date of purchase. The data you provide are required for contract fulfilment and/or for the implementation of pre-contractual measures. Without these data, we cannot conclude the contract with you. Data are not transferred to third parties, except for the transfer of contact details to the transport/shipping company commissioned by us for delivery of the goods, and to our tax advisor to fulfil our tax obligations.
